1. Purpose and scope
These Terms and Conditions govern access to and use of the real estate crowdlending platform operated by Qexloni SpA (Tax ID: 77.456.789-K), with domicile at Av. Apoquindo 4001, Office 1502, Las Condes, Santiago, Chile. By accessing and using the platform, you accept these terms in their entirety.
2. Definitions
Platform: the website qexloni.com and all associated services. User: any natural or legal person who accesses or uses the Platform. Investor: a user who contributes funds to one or more real estate projects through the Platform. Project: each real estate investment opportunity published on the Platform. Developer: a natural or legal person who submits a real estate project for financing through the Platform.
3. Registration and user account
To invest through the Platform, you must create an account by providing truthful and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and all activities carried out under your account. Qexloni reserves the right to verify the identity of users in accordance with current anti-money laundering and counter-terrorism financing regulations.
4. Platform services
Qexloni acts as an intermediary between investors and real estate project developers. Our platform allows users to explore available projects, make investment contributions, and track the progress of construction work. Qexloni does not guarantee the profitability of any project and does not act as a personalized financial advisor.
5. Investment risks
Investing in real estate projects through crowdlending carries inherent risks, including but not limited to: partial or total loss of invested capital, delays in project execution, changes in real estate market conditions, and the risk of default by the developer. Before investing, we recommend that you carefully evaluate your financial situation and risk tolerance.
6. User obligations
The user agrees to provide truthful, complete, and up-to-date information, use the Platform exclusively for its intended purposes, not engage in fraudulent or illegal activities through the Platform, and comply with all applicable laws and regulations, including tax regulations related to investment gains.
7. Intellectual property
All content on the Platform, including texts, graphics, logos, images, software, and its design, are the property of Qexloni SpA or its licensors and are protected by Chilean intellectual property laws and international treaties. Reproduction, distribution, or modification without express written authorization is prohibited.
8. Limitation of liability
Qexloni shall not be liable for direct, indirect, incidental, or consequential damages arising from the use of the Platform or investments made through it. The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, regarding the financial results of investments.
9. Data protection
The processing of your personal data is governed by our Privacy Policy, available at qexloni.com. By using the Platform, you accept the processing of your data in accordance with said policy and current Chilean personal data protection legislation.
10. Applicable law and jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Chile. Any dispute arising from these terms shall be submitted to the jurisdiction of the ordinary courts of justice of the city of Santiago, Chile.
11. Dispute resolution
Before resorting to the courts, the parties will seek to resolve any dispute through direct negotiation. If an agreement is not reached within thirty days, the parties may submit the dispute to mediation before a mediator registered with the Ministry of Justice of Chile.
12. Modifications
Qexloni reserves the right to modify these Terms and Conditions at any time. Changes will take effect from their publication on the Platform. Continued use of the Platform after the publication of changes will constitute your acceptance of them.
